Inscend Terms of Service

Welcome to Inscend ("we," "us," "our"). Inscend is an online platform that acts as a bridge between brands and content creators. We provide a marketplace for brands to launch marketing campaigns and for creators to monetize their work.

By accessing or using our website and services, you ("User," "Creator," "Brand," or "you") agree to be bound by these Terms of Service ("Terms").

Registration: To use the core features of Inscend, you must create an account. You agree to provide accurate, complete, and current information during the registration process and to keep it updated.

Account Security: You are responsible for safeguarding your password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your password or account.

Eligibility: By using our services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

Inscend provides the following services:

Campaign Marketplace: We facilitate connections between Brands and Creators. Brands can post campaigns with specific deliverables, and Creators can apply or be invited to participate.

Campaign Management: We provide tools for Brands to manage and filter campaigns, including the ability to publish private campaigns and restrict access to "Elite Creators" based on criteria determined by Inscend.

Content Approval and Performance Monitoring: Brands must approve content submitted by Creators before it is published. We monitor the performance of approved content to ensure it meets campaign requirements. Performance metrics are determined and tracked by Inscend.

Financial Transactions: We process payments from Brands to Creators based on campaign completion and performance. We hold funds in escrow until campaign deliverables are approved. Creators can withdraw their earned money from their Inscend account to their linked bank account.

Physical Ad Listings: We may offer opportunities for physical ad placements, such as on billboards and public LED displays. These opportunities are subject to separate terms and conditions as specified in each campaign.

Payments to Creators: Payments for completed campaigns and performance bonuses are processed through the Inscend platform. We will transfer funds to your linked bank account upon your withdrawal request. Funds may be subject to a holding period before they become available for withdrawal.

Fees: Inscend reserves the right to charge fees to Brands and/or Creators for the use of our services. These fees, and the details of how they are calculated (e.g., a percentage of campaign value), will be clearly outlined on our website or within specific campaign agreements.

No Guarantee of Earnings: Inscend does not guarantee any level of earnings or a minimum number of campaigns for Creators.

Creator Obligations: You agree to create content that is original, honest, and aligns with the campaign brief. All content must comply with all applicable laws, regulations, and industry standards, including disclosure requirements for sponsored content.

Brand Obligations: Brands agree to provide clear campaign briefs, promptly review and approve content, and make timely payments. Brands are responsible for ensuring their campaigns comply with all laws and regulations.

Accuracy of Information: Both Brands and Creators agree to provide truthful and accurate information about themselves, their services, and their content.

Content Ownership: Creators retain ownership of the content they create. However, by participating in a campaign, Creators grant the Brand a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, and display the content as agreed upon in the campaign brief.

Inscend IP: The Inscend website, its technology, and all content created by us are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of our services without our written consent.

Disclaimer of Warranties: Our services are provided "as is" and "as available." We do not guarantee that the platform will be uninterrupted, error-free, or secure.

Limitation of Liability: To the fullest extent permitted by law, Inscend and its affiliates will not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of the platform.

No Agency Relationship: Inscend is an independent contractor. These Terms do not create a partnership, joint venture, employment, or agency relationship between us and any User.

We may suspend or terminate your account and access to our services at our sole discretion, with or without notice, for any reason, including but not limited to a breach of these Terms.

Governing Law: These Terms are governed by the laws of India.

Changes to Terms: We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Effective Date" at the top of this page. Your continued use of the platform constitutes your acceptance of the revised Terms.
